1. Who may use the Service
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. The Service may include mature or explicit romantic content depending on the heat level you select. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes the entity.
2. The Service
Crush Chapters provides software that helps users create personalized romance serial fiction — including character preferences, story outlines, multi-chapter serials, sample stories, and an account dashboard for reading and billing. Features may change, be added, or be removed at any time. We may offer beta or experimental features without guarantees.
3. Accounts & security
- You are responsible for your account credentials and all activity under your account.
- You must provide accurate registration information and keep it current.
- Notify us promptly at legal@crushchapters.com if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms or pose security, legal, or operational risk.
4. Credits, billing & refunds
- Paid features are sold as prepaid chapter credits unless otherwise stated at checkout.
- Prices are shown before purchase and processed by Stripe. Taxes may apply. Promotional pricing or codes may change the amount charged.
- Credits are consumed when chapters are generated for your account (including higher costs for certain heat levels, such as explicit content, when applicable). Failed generation items may receive automatic credit refunds when reflected in your billing history.
- Except where required by law, all sales are final. Purchased credits are non-refundable once issued, including unused credits, except at our sole discretion or where mandatory consumer laws apply.
- Free samples, promotional credits, and trial allowances may be limited, modified, or withdrawn at any time.
5. Sample stories & fair use
Public sample serials and similar offerings are provided for evaluation and marketing. You may not scrape sample content at scale, redistribute it as your own commercial product, or attempt to bypass account or usage limits.
6. Acceptable use
You agree not to:
- Violate any law, regulation, or third-party rights (including intellectual property, privacy, and publicity rights);
- Submit or request unlawful, harmful, deceptive, defamatory, harassing, or infringing content;
- Request, generate, or distribute sexual or pornographic content involving anyone 17 or under, or any content that sexualizes minors — including fictional depictions;
- Request non-consensual intimate depictions of real people (including deepfakes or lookalike prompts of identifiable individuals) without their authorization;
- Reverse engineer, probe, or interfere with the Service except as permitted by law;
- Access the Service through unauthorized means, share account access, or resell access without our written permission;
- Overload, disrupt, or attempt to gain unauthorized access to our systems or providers;
- Misrepresent AI-generated fiction as solely human-written where disclosure is required by law or platform policy.
We may investigate violations and cooperate with law enforcement or providers as we deem appropriate.
7. Your content
You retain ownership of content you submit (character preferences, prompts, custom details, and similar inputs). You grant Crush Chapters a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, and otherwise use your content solely to provide, secure, maintain, and improve the Service and as described in our Privacy Policy.
You represent and warrant that you have all rights necessary to submit your content and that your content and use of the Service do not violate these Terms or applicable law.
8. AI-generated stories
Output is generated automatically and may be inaccurate, inconsistent, incomplete, or unsuitable for your preferences. You are solely responsible for reviewing stories and deciding whether to read, share, or rely on any output. Crush Chapters does not guarantee narrative quality, continuity, emotional outcomes, or suitability for any purpose.
Fiction generated by the Service is entertainment. It is not advice, counseling, or a depiction of real people unless you intentionally provide such details — which you should not do for identifiable individuals without authorization.
9. Our intellectual property
Crush Chapters and its licensors own the Service, including software, models, workflows, branding, documentation, sample stories we publish, and site content (excluding your submitted content and output you lawfully obtain through the Service). No rights are granted except as expressly stated in these Terms.
You may reference Crush Chapters in accordance with any brand guidelines we publish; otherwise, do not imply endorsement or partnership without permission.
10. Third-party services
The Service integrates with third parties (including Google/Firebase, Stripe, cloud providers, and AI infrastructure). Their terms and privacy policies apply to their services. Crush Chapters is not responsible for third-party products, outages, or acts.
11. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including payment obligations, disclaimers, limitations, indemnities, and dispute terms) will survive.
12. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRUSH CHAPTERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that output will meet your requirements or expectations.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRUSH CHAPTERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CRUSH CHAPTERS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless Crush Chapters and its officers, directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your content or output you share; (b) your use of the Service; (c) your violation of these Terms or applicable law; or (d) your negligence or willful misconduct.
15. Privacy
Our Privacy Policy explains how we collect and use personal information and is incorporated into these Terms by reference.
16. Changes
We may modify these Terms at any time. The effective date above will reflect the latest version. Material changes may be posted on the Service or communicated by reasonable means. Continued use after changes become effective constitutes acceptance, to the extent permitted by law.
17. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
Before filing a claim, you agree to contact us at legal@crushchapters.com and attempt to resolve the dispute informally for at least thirty (30) days.
Except for small-claims matters eligible in your local court, any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.
18. General
- Entire agreement: These Terms and the Privacy Policy are the entire agreement regarding the Service.
- Severability: If any provision is unenforceable, the remainder stays in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganization.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
